After Backsliding: New Questions and Responses to Norm Erosion

Many believe that we are living through an age of global democratic decay and of decline in the rule of law. But how should public law respond to the challenges that this age entails and especially to the gradual yet palpable erosion of norms? The papers presented in this panel all seek to shed light on different aspects of this question that go beyond existing approaches and to expand the institutional and doctrinal toolboxes available to decision-makers. Among the topics addressed in the panel will be: -The uses and abuses of presidential impeachment around the world -Reimagining militant democracy in the wake of the global constitutional recession -A third way in adjudicating constitutional rights beyond proportionality and categorical rules -The need for more pragmatic attitudes towards the rule of law in the European system
