Book Discussion: The proportionality of punishment as a constitutional principle (English/Spanish)

The panel is aimed at presenting the recently published book by Francesco Viganò, judge of the Italian Constitutional Court, dealing with the topic of proportionality of punishment (Viganò, La proporzionalità della pena, Giappichelli, 2021). The subject is addressed from a comparative perspective, especially through the lens of the case-law of constitutional courts. The key points of the book will be summarized in a working paper in English, made available in advance to the discussants, and briefly introduced by the author at the beginning of the panel. All panelists will take turns as discussants, to debate the strengths and weaknesses of the approach adopted in the book, aimed at framing the proportionality of punishment as a fundamental constitutional principle. The presence of scholars from different European (Germany, Italy, Spain) and non-European (Chile, United States) legal systems will certainly foster a comprehensive and interesting discussion on the book and on its topic.
