Constitutional Change and Unconstitutional Constitutional Amendments: a Latin American Perspective

This panel explores different dimensions of constitutional change, focusing in particular on unconstitutional constitutional amendments and eternity clauses. First, it addresses the role of the Brazilian Federal Supreme Court concerning amendment proposals which may abolish unamendable clauses of the constitution – second, it expands on the Brazilian case, assessing to what extent constitutional changes, both formal and informal, have led to a “constitutional denaturation“ – third, it addresses the issue from the perspective of parliamentary oversight. The panel aims to foster a debate on Latin American constitutionalism and constitutional change, providing insights on the role of different actors – not only courts –, as well as a theoretical and comparative understanding of the issue.
