Constitutional Justice and rights (Spanish)

The purpose of this panel, which will be held in Spanish, is to discuss the role of Constitutional Courts in guaranteeing rights. Particular attention will be paid to the role of constitutional justice in times of the COVID-19 pandemic. The presentations included in this panel advocate for a necessary dialogue between the Inter-American Human Rights System and the national constitutional courts, to offer creative responses to problems of constitutional relevance that, otherwise, would not obtain a satisfactory solution if the source were exclusively national law. On the same path, the issue of integral reparation is shown as an alternative to correct the problems of structural inequality faced by democracies in the region. On the other hand, in the context of the COVID-19 pandemic, the jurisprudence of the Constitutional Court of Ecuador will specially when it comes to the declarations of state of emergency and their impact on rights.
