Freedom of Expression and Religious Beliefs: Current Trends of a Challenging Balance
The equilibrium between freedom of expression and the protection of religious beliefs is always precarious and in progress. The balance that the legal systems establish is the result of a weighting among constitutional values and principles, international law standards, and political and cultural issues. In the panel, the speakers discuss current trends in a comparative perspective regarding ECtHR‘s jurisprudence, human rights norms developed in the international community, the Italian constitutional law and the new technologies. Even in the international community, as well as in the domestic legal orders, such a balance takes into consideration a variable set of values and arises from the prevalence of a political or cultural option. The panel also focuses on the digital environment, where freedom of expression is displayed through the medium of private social platforms, which exercise forms of algorithmic censorship.
