Regional Courts and the Sustainability of Democracy

Judgments issued by the European Court of Human Rights (ECtHR) and the Inter-American Court of Human Rights (IACtHR) generate significant legal and economic consequences on national landscapes. Their implementation at the national level is among the main indicators of the status of the protection of human rights and, ultimately, of the health of the rule of law and democracy in each State party as well as in the region. However, it is no surprise that in both continents, certain States seek to escape the scrutiny of the competent regional Court. The aim of this panel is to analyse the legal consequences of the implementation of the ECtHR and the IACtHR judgments at the national level, with a specific focus on cases in which the regional court Concerned uses the “democratic argument“ (arguments related to democracy, political rights and electoral justice – Article 3 of Protocol 1 to the European Convention on Human Rights or Article 23 of the American Convention on Human Rights)
