The Future of Public Law: What Does Legal Philosophy and Theory Offers?
This panel will reconsider the future of public law from the perspective of legal philosophy. For that purpose, the panelists will assess the contributions not only of Hans Kelsen, H.L.A. Hart, Ronald Dworkin, Robert Alexy, Catherine MacKinnon, Günter Teubner, among others, to public law, but also its prospective for the near future. These contributions vary from their theories of constitutionalism and democracy, from institutional design to day-to-day adjudication via constitutional interpretation and judicial decision-making, including critical and feminist theories.
